1. Acceptance of Terms
By accessing or using Myapplykit (the “Service”, available at myapplykit.com), creating an account, or clicking “Create account”, you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated by reference.
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and “you” refers to both you individually and that organisation.
If you do not agree to these Terms, you must not access or use the Service.
2. Description of Service
Myapplykit is an AI-assisted job-search workspace that provides:
- CV and cover letter drafting and tailoring assistance
- Job listing evaluation and fit scoring against your profile
- Application pipeline tracking and status management
- Story and example bank for interview preparation
- Company research and watchlist tools
- AI-generated coaching, feedback, and recommendations
- Job board aggregation (via Adzuna and similar feeds)
The Service uses large-language-model AI (currently Anthropic Claude) to generate content and recommendations. AI capabilities are subject to change as we update underlying models and features.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with reasonable notice where practicable. We will not be liable for any modification, suspension, or discontinuation.
3. Eligibility
To use the Service you must:
- Be at least 16 years old (or the minimum digital age of consent in your jurisdiction if higher);
- Have the legal capacity to form a binding contract in your jurisdiction;
- Not be a person barred from receiving services under applicable law (including UK/EU sanctions lists or US OFAC designations); and
- Not have previously had a Myapplykit account terminated for cause.
The Service is not directed at children under 16. If you become aware that a child under 16 has provided us with personal data, please contact us at support@myapplykit.com and we will delete it promptly.
4. Your Account
4.1 Registration
You must provide accurate, current, and complete registration information and keep it up to date. Using a false identity or another person’s information is prohibited.
4.2 Account Security
You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must:
- Use a strong, unique password of at least 10 characters;
- Not share your credentials with any third party;
- Notify us immediately at support@myapplykit.com if you suspect unauthorised access or any security breach.
We are not liable for losses caused by unauthorised use of your account where you have failed to keep your credentials secure.
4.3 One Account Per Person
Each account is for individual, personal use only. Creating multiple accounts to circumvent usage limits or access restrictions is prohibited.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to generate, transmit, or store content that is unlawful, defamatory, harassing, threatening, obscene, discriminatory, or fraudulent;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity (including falsifying job application materials beyond reasonable professional presentation);
- Use AI output to submit applications that materially misrepresent your qualifications, experience, or identity;
- Attempt to gain unauthorised access to the Service, its servers, or any data belonging to other users;
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive source code from the Service;
- Use automated means (bots, scrapers, crawlers) to access or extract data from the Service without our prior written consent;
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure;
- Upload or process content that infringes third-party intellectual property, privacy, or other rights;
- Attempt to circumvent, disable, or interfere with usage limits, billing controls, or access restrictions;
- Resell, sublicense, or provide the Service as a service bureau to third parties without our written consent;
- Use the Service in any way that could bring Myapplykit into disrepute or violate applicable law.
We reserve the right to investigate suspected violations and to take appropriate action, including suspension or termination of your account, reporting to law enforcement, and seeking injunctive or other equitable relief.
6. AI-Generated Content
6.1 Nature of AI Output
The Service uses large-language-model AI to generate suggestions, evaluations, cover letters, CV edits, coaching feedback, and other content. You acknowledge that:
- AI output may be inaccurate, incomplete, outdated, biased, or otherwise unsuitable;
- The same prompt may produce different output at different times;
- AI models can “hallucinate” — generating plausible-sounding but factually incorrect information;
- AI fit scores and evaluations are indicative only and are not predictive of actual hiring outcomes.
6.2 Your Responsibility
You are solely responsible for reviewing, verifying, and deciding whether to use any AI-generated content. Do not submit application materials, make employment decisions, or take any other action based solely on AI output without your own independent review.Myapplykit is not a recruitment agency and does not provide professional career, legal, financial, or psychological advice.
6.3 No Training on Your Data
We do not use your personal content (CVs, job applications, profile data) to train or fine-tune AI models. Your content is processed solely to provide the Service to you.
6.4 Ownership of AI Output
To the extent permitted by applicable law, AI-generated content produced in response to your prompts and inputs belongs to you. You are responsible for ensuring that content you submit to third parties (including employers) complies with any applicable disclosure requirements regarding AI-generated materials.
7. Your Content
7.1 Ownership
You retain full ownership of all content you upload, create, or store in the Service, including CVs, cover letters, profile data, notes, job listings you save, and any other materials (“Your Content”).
7.2 Licence to Us
By uploading or creating content in the Service, you grant Myapplykit a limited, non-exclusive, royalty-free, worldwide licence to store, process, and transmit Your Content solely to provide and improve the Service to you. This licence terminates when you delete the content or close your account, subject to our data retention obligations.
7.3 Your Warranties
You represent and warrant that: (a) you own or have the necessary rights to Your Content; (b) Your Content does not infringe the intellectual property, privacy, or other rights of any third party; and (c) Your Content complies with these Terms and all applicable laws.
7.4 Sensitive Personal Data in CVs
CVs often contain sensitive personal information about you (health, religion, political views, etc.). You upload such information voluntarily. We process it only to provide the Service and handle it in accordance with our Privacy Policy.
7.5 Data Portability and Deletion
You may export Your Content at any time from your account settings. Upon account deletion, we will delete Your Content within 30 days, except where retention is required by law (e.g., transaction records retained for 7 years).
8. Subscriptions and Billing
8.1 Plans
We offer the following plans (prices may change with notice as described in Section 8.5):
- Free — limited AI credits per month, core features available at no charge;
- Basic — £19/month (or local equivalent), expanded AI credits and full feature access;
- Pro — £49/month (or local equivalent), maximum AI credits, priority processing, and all current and future Pro features.
Credit packs (one-time add-ons) are available for purchase at rates shown in-app. Purchased credits expire 12 months from the date of purchase.
8.2 Billing Cycle
Paid subscriptions are billed monthly in advance. Your billing cycle begins on the date you first subscribe. Payments are processed by Stripe. You authorise us to charge your payment method on each renewal date until you cancel.
8.3 Taxes
Prices shown are exclusive of any applicable taxes (including VAT/GST). You are responsible for all taxes, duties, or levies applicable to your purchase. Where we are required to collect taxes, they will be added at checkout.
8.4 Failed Payments
If a payment fails, we will notify you and may retry the charge. If payment remains outstanding after a reasonable retry period, we may downgrade your account to the Free tier or suspend access until payment is resolved.
8.5 Price Changes
We reserve the right to change subscription prices. We will give you at least 30 days’ written notice (by email to your registered address) of any price increase. The new price will apply from your next billing cycle after the notice period. If you do not wish to continue at the new price, you may cancel before the change takes effect.
9. Cancellation and Refunds
9.1 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at support@myapplykit.com. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date, after which your account will revert to the Free tier.
9.2 Refunds
We do not offer refunds for partial billing periods, except:
- Where required by applicable consumer protection law (including UK Consumer Rights Act 2015 and, where applicable, EU Directive 2011/83/EU on consumer rights);
- Where the Service has experienced a significant, prolonged outage that materially impaired your use during a paid period (assessed at our reasonable discretion);
- Where we terminate your account for reasons other than your breach of these Terms.
Purchases of credit packs are non-refundable once credits have been consumed. Unused credits on a terminated account are forfeited.
9.3 UK/EU Statutory Cooling-Off Right
If you are a consumer in the UK or EU, you may have a statutory 14-day right of withdrawal from a digital service contract. However, by agreeing to these Terms and requesting immediate access to the Service at account creation, you acknowledge that performance begins immediately and you expressly waive your right of withdrawal once you have started using the Service.
10. Free Tier and Trial Credits
Free-tier accounts are subject to usage limits (AI credits, storage, features) that may change at our discretion. We reserve the right to:
- Modify, reduce, or remove free-tier allowances with reasonable notice;
- Require email verification to access free features;
- Throttle or queue requests from free-tier accounts during high-demand periods.
Any promotional or trial credits are provided as a courtesy, have no cash value, cannot be transferred, and expire as indicated at the time they are granted.
11. Intellectual Property
11.1 Our Ownership
The Service, including its software, design, user interface, branding, trademarks, trade secrets, databases, and all other content or materials created by Myapplykit, is owned by or licensed to us and protected by copyright, trademark, and other intellectual property laws of England and Wales and applicable international treaties. All rights not expressly granted are reserved.
11.2 Limited Licence to You
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial job-search purposes.
11.3 Restrictions
You must not copy, modify, create derivative works from, publicly display, publish, sublicense, sell, resell, or otherwise exploit any portion of the Service without our prior written consent.
11.4 Feedback
If you submit feedback, suggestions, or ideas about the Service, you grant us an irrevocable, perpetual, royalty-free licence to use that feedback in any manner. We have no obligation to act on feedback or to compensate you for it.
12. Third-Party Services
The Service integrates with or relies on the following third-party services, each governed by their own terms and privacy policies:
- Anthropic — AI model provider (anthropic.com/legal/privacy)
- Stripe — payment processing (stripe.com/privacy)
- Auth0 — Google social login (auth0.com/privacy)
- Resend — transactional email (resend.com/privacy)
- Sentry — error monitoring (sentry.io/privacy)
- Adzuna — job listing data (adzuna.co.uk/privacy)
We are not responsible for the practices of third-party services. Links to or integrations with third-party platforms are provided as a convenience and do not constitute our endorsement of those platforms.
If a third-party service you connect to the Service (e.g., through future integrations) ceases to be available, we may discontinue that integration without liability.
13. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share your personal data. By using the Service, you consent to the data practices described in the Privacy Policy.
If you are located in the UK or EU, you have additional rights under the UK GDPR / Data Protection Act 2018 and the EU General Data Protection Regulation. These are detailed in the Privacy Policy.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR ANY PURPOSE; (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED; OR (E) USE OF THE SERVICE WILL RESULT IN JOB OFFERS, INTERVIEWS, OR ANY PARTICULAR CAREER OUTCOME.
Nothing in these Terms affects your statutory rights as a consumer that cannot be excluded under applicable law (including, in the UK, the Consumer Rights Act 2015).
15. Limitation of Liability
15.1 Exclusion of Indirect Losses
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYAPPLYKIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING WITHOUT LIMITATION: LOSS OF PROFITS; LOSS OF DATA; LOSS OF GOODWILL; LOSS OF EMPLOYMENT OPPORTUNITIES OR CAREER OUTCOMES; SERVICE INTERRUPTION; COMPUTER DAMAGE OR SYSTEM FAILURE; OR THE COST OF SUBSTITUTE SERVICES.
15.2 Cap on Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE FORM OF ACTION, SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) £100 (ONE HUNDRED POUNDS STERLING).
15.3 Exceptions
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law (including the UK Consumer Rights Act 2015 and the Unfair Contract Terms Act 1977).
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Myapplykit and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Service in violation of these Terms;
- Your Content (including any claim that Your Content infringes third-party rights);
- Your violation of any applicable law or regulation; or
- Your fraud, wilful misconduct, or gross negligence.
This indemnification obligation does not apply to the extent that a claim arises from our own negligence, wilful misconduct, or breach of these Terms. If you are a consumer in the UK or EU, this clause applies only to the extent permitted by applicable consumer protection law.
17. Copyright and DMCA
We respect intellectual property rights. If you believe that content on the Service infringes your copyright, please send a notice to support@myapplykit.com containing:
- Identification of the copyrighted work claimed to be infringed;
- Identification of the allegedly infringing material and its location on the Service;
- Your contact information (name, address, telephone, email);
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury (if applicable in your jurisdiction), that the information in your notice is accurate and that you are the copyright owner or authorised to act on its behalf; and
- Your physical or electronic signature.
We will respond to valid notices in accordance with applicable law and our policies. Repeat infringers may have their accounts terminated.
18. Termination
18.1 Termination by You
You may close your account at any time by using the account deletion option in settings or by contacting support@myapplykit.com. Deletion will take effect within a reasonable time and your data will be handled in accordance with our Privacy Policy.
18.2 Termination by Us
We may suspend or terminate your account and access to the Service immediately and without prior notice if:
- You materially breach these Terms and fail to remedy the breach within 7 days of notice;
- We determine, in our reasonable discretion, that you have violated the Acceptable Use Policy;
- We are required to do so by law or regulatory order;
- We reasonably believe your account has been compromised or is being used fraudulently; or
- We decide to discontinue the Service.
18.3 Effect of Termination
Upon termination: (a) all licences granted to you cease immediately; (b) you must stop using the Service; (c) we will delete or anonymise your data in accordance with our Privacy Policy; and (d) any outstanding payment obligations survive termination. Sections 5, 6.4, 7.3, 11, 14, 15, 16, 20, and 21 survive termination of these Terms.
18.4 Termination for Service Discontinuation
If we terminate the Service entirely (not for cause), we will provide at least 30 days’ notice and pro-rate a refund for any unused paid subscription period.
19. Changes to These Terms
We may update these Terms from time to time. For material changes (changes that affect your rights or obligations in a meaningful way), we will:
- Notify you by email to your registered address at least 14 days before the changes take effect;
- Post a prominent notice on the Service; and
- Update the “Effective date” at the top of this page.
Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you must stop using the Service and may close your account.
For non-material changes (e.g., corrections, clarifications, or additions that do not reduce your rights), we will update the Terms with a revised effective date, without advance notice.
20. Dispute Resolution and Governing Law
20.1 Informal Resolution
Before commencing any formal proceedings, we encourage you to contact us at support@myapplykit.com to try to resolve any dispute informally. We will attempt to resolve the matter within 30 days of receiving your written description of the dispute.
20.2 Governing Law
These Terms and any dispute or claim (including non-contractual disputes) arising out of or in connection with them, their subject matter, or formation shall be governed by and construed in accordance with the laws of England and Wales.
20.3 Jurisdiction
Subject to Section 20.4, each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
20.4 Consumer Rights
If you are a consumer habitually resident in the UK or EU, you retain the right to bring a claim before the courts of your country of residence. Nothing in these Terms limits your right to use alternative dispute resolution (ADR) services. UK consumers may also use the Resolver platform or refer complaints to relevant ombudsman schemes.
21. General Provisions
21.1 Entire Agreement
These Terms (together with the Privacy Policy and any additional terms presented to you at the time of a specific transaction) constitute the entire agreement between you and Myapplykit with respect to the Service and supersede all prior agreements, representations, and understandings.
21.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms continue in full force and effect.
21.3 Waiver
Our failure to enforce any right or provision of these Terms on one occasion will not constitute a waiver of that right or provision on any future occasion. A waiver of any right must be in writing and signed by an authorised representative of Myapplykit to be effective.
21.4 Assignment
You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation, or sale of all or substantially all of our assets, with notice to you.
21.5 Force Majeure
Neither party will be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including acts of God, war, terrorism, pandemic, government action, internet or infrastructure failures, or third-party service outages.
21.6 No Third-Party Beneficiaries
These Terms are for the benefit of you and Myapplykit only. Nothing in these Terms gives rise to any right under the Contracts (Rights of Third Parties) Act 1999 or otherwise for any third party to enforce any term.
21.7 Notices
Notices to Myapplykit must be sent by email to support@myapplykit.com. We will send notices to the email address associated with your account.
